    ACORN fired the employees, and then files a lawsuit that says “…the employees, Tonja Thompson and Shera Williams, suffered “extreme emotional distress.””….when ACORN did the firing on a knee-jerk reaction.

    I suppose that makes sense to a lawyer. But I doubt that Giles & O’Keefe are without a plan. So I’m stocking up on the popcorn!

    I am not a lawyer, and I have not seen the filings, but I am going to guess that the filings are very carefully worded to mention only the fact of the allegedly illegal voice recordings, with no mention of why the recordings were made, just that they were.

    I think that will limit discovery to pretty much safe territory.

    As usual, public safeguards will work against us.

  3. I’m not a lawyer either Larry, but I’m pretty sure the defense can open up the discovery pretty wide in their own right. And a lawsuit prectically guarantees significant press coverage of the issue, even if some of the media dinosaurs might want to quash the story.

    There will be some good legal talent available to Giles and O’Keefe, courtesy of BigGovernment and concerned citizens everywhere. I’m not worried about them.

    It seems to me that there has been lots of opportunity for discovery from the criminal charges filed against numerous ACORN employees through the past few years. But I guess those were federal prosecutors and this is a civil case.

    I’m not a lawyer, yet, and I claim no special understanding but now that there is an action, the counter suits will keep this going, I’m sure, even if ACORN non-suits. But they wouldn’t do that, it’s in their best interest to sue.

    I’m wondering how ACORN thinks it’s going to get $500,000 for each employee out of two college students. Unless they’re independently wealthy it seems a bit of a stretch.

    Remember that B. Hussein said that when they hit you, hit them back harder. I think their intent is to simply make it very painful for these neo-journalists to continue their business.

    Remember that it doesn’t matter what happens to ACORN. If we get every hidden, lurid secret and they are exposed to the world, it matters not one bit. The money and the people will just reconstitute into another organization and they’ve got three years to do it.

    So it doesn’t matter if there’s discovery. It doesn’t matter if they lose their lawsuit. They are going to cost O’Keefe money and time to defend, that money will come from idealistic supporters, while the money for ACORN’s lawyers is being subsidized by the government.

    Don’t kid yourselves. This is not a win. It’s another skirmish in the war to make us another banana republic like Venezuela or Cuba. So far, they’re winning.

    We’re doomed.

    The availability of discovery in criminal court, under the federal rules and most state’s rules, is generally pretty limited. Not here in Florida, but that’s another story.

    No it’s not. They may think it is, but that’s because they’re left-wing loons who are used to being completely untouchable.

    Two words: civil RICO. Breitbart, Giles and O’Keefe will have lawyers lined up out the door to take ACORN apart. State AG’s will join them and widen the countersuits (Louisiana’s already started). RICO is the broadest net for discovery, and the biggest hammer for damages, that anyone could possibly ask for.
