This whole Rahm Emanuel story is getting delish. He jumps like a rat from a sinking ship resigns from his post as White House Chief of Staff to run for Mayor of Chicago.

Except he may not be legally eligible

The first question isn’t: Can Rahm win? It’s: Can Rahm run?

Sunday, Rahm Emanuel announced in a video posted on a website that he is preparing to run for mayor of Chicago. But two of Chicago’s top election lawyers say the state’s municipal code is crystal clear that a candidate for mayor must reside in the town for a year before the election.

That doesn’t mean they must simply own a home in the city that they rent out to someone else. They must have a place they can walk into, keep a toothbrush, hang up their jacket and occasionally sleep, the lawyers say.

…But when Emanuel agreed to become chief of staff, the family moved out to D.C. and the home was rented out to another family that now refuses to break the lease and clear the way for Emanuel to move back in. Emanuel could come back to Chicago to vote, but he could not stop at the house he owns on his way to the polling place, and that does not meet the residency test to run for mayor, Nally said.

But really, Chicago, Rahm loves you and he’s very glad to be “here.”

As long as you have a Clintonian definition of “here”

Rahm Emanuel kicked off his campaign for Mayor of Chicago with a homecoming video, filmed in front of a bookshelf with a vase and a family photograph.

“I was born here and my wife Amy and I raised our three children here,” he says. “I’m glad to be home.”

But an Emanuel spokeswoman, Lori Goldberg, confirms that the video itself was actually filmed in Washington, D.C., in the offices of AKPD media, the firm founded by David Axelrod.

    Of course they’ll find a loophole, it’s Chicago. Plus he’ll probably get more dead votes than live so he’ll win going away.

    He’ll buy off a judge to get the law deemed unconstitutional, most likely.

    Or he’ll just ignore the requirement.
